Cristhian Bahena Rivera, the undocumented immigrant accused of killing University of Iowa student Mollie Tibbetts is claiming that his constitutional right against self-incrimination was violated by law enforcement officials.
According to Bahena Rivera’s attorneys, he was not informed of his right to an attorney or his right to decline to cooperate before being subjected to the 12-hour interview during which the 24 year old farm worker purportedly confessed to abducting Tibbetts while she was on a run July 18. If this were true, the Court could rule that the confession was involuntary and inadmissible as evidence against him.
Bahena Rivera, was charged with first-degree murder in the stabbing death of Molly Tibbets after he led investigators to her body in a rural Poweshiek County cornfield.
